Alexander Ternovoy, Chairman of board of directors of Altaiskiye Zakroma Agro-Industrial Holding, claimed that representatives of Central Internal Affairs Directorate slander his business taking offence at appealing to Public prosecutor of the Altai territory Yakov Horoshev. Central Internal Affairs Directorate doesn’t comment the situation saying that court must analyze the problem.
OPEN THE DOOR! IT’S THE POLICE!
The clash between Altaiskiye Zakroma Agro-Industrial Holding and Central Internal Affairs Directorate has begun since April of the current year. A notification which informed that special investigation activities would be conducted in the plant was given to the director of Bread-making plant №4. The notification dated April 16. The inspection was confirmed by Vice-chief of Central Internal Affairs Directorate, Major General Vyacheslav Novikov.
Altaiskiye Zakroma considered the inspection to be illegal and appealed to the public prosecutor's office of the Altai territory. Referring to the changes in Police Act of 2008 Alexander Ternovoy claims that any autonomous tax inspection of the companies is impossible by internal affairs officers. Besides Mr. Ternovoy refers to the order of Minister of RF MIA Rashid Nurgaliev which regulates activities of police officers during such inspections. In the order and instructions it is really said that internal affairs officers must just provide security to the tax inspectors.
However, on 11 June special investigation activities were conducted in Bread-making plant №4 after all. There were no tax inspectors at all. According to Alexander Ternovoy a group of 12 authorized operatives accompanied by riot policemen blocked the entrance into the territory of the plant and buildings at 8 o’clock in the morning. The usage of mobile and fixed location phones by employees of the plant was prohibited as well as the usage of computers.
WHAT WAS BEING LOOKED FOR?
According to Mrs. Bolhovitina, Chief of the legal department of the plant, authorized operatives especially wanted to know where the office of the leader of Altaiskiye Zakroma Agro-Industrial Group was. But when they were explained that there was no such an office in the building they turned their attention to the office of the director of the bread-making plant. According to Mrs. Bolhovitina the police officers didn’t state in concrete terms what they were looking for. She says, ‘Their requirements became clear only after the leaders had come to the plant. All the necessary documents were handed to them during thirty minutes.’
Alexander Ternovoy says that he doesn’t worry about financial and physical damage. He says, ‘Tax inspections are like free audit of the company for me. Our money turnover is enormous, so technical errors are inevitable. We check for these errors and eliminate them with the help of inspectors. Today it is cheaper to live in accordance with the law. Why is the law broken in relation to the entrepreneurial community if we comply with the law?’
When asked to comment the situation Central Internal Affairs Directorate made a pause at first and then rejected to do it.
WHAT IS ALL THE FUSS ABOUT?
Alexander Ternovoy, Chairman of board of directors of Altaiskiye Zakroma Agro-Industrial Holding, says,
‘One more unpleasant fact of this situation is a formal reason for special investigation activities. We bought sugar from a Novosibirsk company at a favorable price. We had inquired about all the necessary documents before we concluded a contract. We hadn’t had any problems with the company before law enforcement officers informed us that it was registered with a passport of a person of no fixed abode. Police officers suspected that we avoided paying taxes using a shadow company. We don’t have means to find out whether our contractor pays taxes or not. We had a similar situation three years ago. It’s funny but the company which was considered to be a shadow company is still in the Unified State Register of Legal Entities. A criminal case was not initiated then.
PS As it was reported on October 20 the Oktyabrsky district court proclaimed the activities of the police officers illegal.
